These General Terms and Conditions (GTC) apply to all orders placed by consumers (§ 13 BGB) and entrepreneurs (§ 14 BGB) via the seller's online shop.

3. Offer and conclusion of contract
(1) The presentation of the products in the online shop does not constitute a legally binding offer, but a non-binding invitation to place an order.
(2) By clicking the „Buy now“ button, the customer submits a binding offer.
(3) Acceptance is effected by an order confirmation via e-mail.
4. Prices and small business regulation
All prices are final prices according to Section 19 of the German VAT Act.

5. Shipping and Delivery
(1) Delivery shall take place worldwide.
(2) The applicable shipping costs will be displayed during the order process.
(3) For deliveries to non-EU countries, customs duties, taxes or other charges may apply, which are to be borne by the customer.

6. Payment
The payment methods offered in the shop are displayed at checkout.
The purchase price is due immediately.
7. Right of withdrawal

8. Exclusion of the right of withdrawal for sealed TameGuard products (hygiene products)
(1) All offered TameGuard products, including PETG cage components, TPU soft spikes, rings and lock, are intimate body contact items and therefore hygiene items.
(2) The products will be in a hygienically sealed individual packaging delivered (e.g. sealed bubble wrap).
(3) Once this hygiene seal has been opened or damaged, a return is not possible., as the goods are not suitable for return for reasons of health protection and hygiene (§ 312g para. 2 no. 3 BGB).
(4) A revocation is possible as long as the seal remains intact. undamaged is.
9. Warranty (Liability for Defects)
(1) The statutory warranty period of 24 months applies.
(2) TameGuard products are sold in the 3D printing process manufactured. Minor visible layer lines, surface textures, minimal deviations or slight dimensional tolerances are due to the manufacturing process and represent no shortage provided that function and safety are not impaired.
(3) In the event of material defects, breakage, manufacturing defects or missing components, the customer shall receive a free replacement or a refund.
(4) The warranty excludes damage caused by:
– improper or unintended use,
– wrong size choice,
– excessive mechanical stress,
– independent modifications,
– Use contrary to the product instructions,

10. Liability
(1) The seller shall be liable without limitation for claims by the customer for damages.
– in the event of damage resulting from injury to life, body or health,
– in cases of intentional or grossly negligent conduct.
(2) In cases of slight negligence, the seller shall only be liable for breaches of essential contractual obligations (cardinal obligations). In this case, liability shall be limited to foreseeable damages typical for this type of contract.
(3) TameGuard accepts no liability for damages resulting from improper, negligent, risky, or unintended use of its products. This includes, in particular:
– Use of ring sizes that are too tight or unsuitable,
– excessively long or uninterrupted wearing times,
– improper fastening of the components,
– Overstretching, tension or excessive pressure,
– Use during physically demanding or risky activities,
– Modification or manipulation of the products.
(4) The seller accepts no liability for skin reactions such as redness, irritation, pressure sores, or individual intolerance reactions to PETG or TPU. Such reactions are usage-related and person-specific and do not constitute a defect.
(5) The customer is responsible for checking for possible allergies or intolerances to the materials used.
11. Retention of title
The goods remain the property of the seller until full payment has been received.

13. Choice of law and jurisdiction
(1) German law shall apply, excluding the UN Convention on Contracts for the International Sale of Goods.
(2) In relation to consumers outside Germany, this choice of law shall only apply to the extent that it does not deprive them of the protection afforded by mandatory legal provisions of their country of residence.
(3) For entrepreneurs, the place of jurisdiction is Kaiserslautern.
