1. Scope<\/strong><\/h2>\n\n\n\n

These General Terms and Conditions (GTC) apply to all orders placed by consumers (\u00a7 13 BGB) and entrepreneurs (\u00a7 14 BGB) via the seller's online shop.<\/p>\n\n\n\n

2. Contracting parties<\/strong><\/h2>\n\n\n\n

The seller does not participate in dispute resolution proceedings before a consumer arbitration board.<\/p>\n\n\n\n

3. Offer and conclusion of contract<\/strong><\/h2>\n\n\n\n

(1) The presentation of the products in the online shop does not constitute a legally binding offer, but a non-binding invitation to place an order.
(2) By clicking the \u201eBuy now\u201c button, the customer submits a binding offer.
(3) Acceptance is effected by an order confirmation via e-mail.<\/p>\n\n\n\n

4. Prices and small business regulation<\/strong><\/h2>\n\n\n\n

All prices are final prices according to Section 19 of the German VAT Act<\/strong>.

5. Shipping and Delivery<\/strong><\/h2>\n\n\n\n

(1) Delivery will take place worldwide<\/strong>.
(2) The applicable shipping costs will be displayed during the order process.
(3) For deliveries to non-EU countries, customs duties, taxes or other charges may apply, which are to be borne by the customer.
(4) The delivery times stated in the online shop are considered to be estimated.<\/p>\n\n\n\n

6. Payment<\/strong><\/h2>\n\n\n\n

The payment methods offered in the shop are displayed at checkout.
The purchase price is due immediately.<\/p>\n\n\n\n

7. Right of withdrawal<\/strong><\/h2>\n\n\n\n

Consumers have the statutory right of withdrawal.

8. Exclusion of the right of withdrawal for sealed TameGuard products (hygiene products)<\/strong><\/h2>\n\n\n\n

(1) All offered TameGuard products<\/strong>, including PETG cage components, TPU soft spikes, rings and lock, are intimate body contact items and therefore hygiene items.
(2) The products will be in a hygienically sealed individual packaging<\/strong> delivered (e.g. sealed bubble wrap).
(3) Once this hygiene seal has been opened or damaged, a return is not possible.<\/strong>, as the goods are not suitable for return for reasons of health protection and hygiene (\u00a7 312g para. 2 no. 3 BGB).
(4) A revocation is possible as long as the seal remains intact. undamaged<\/strong> is.<\/p>\n\n\n\n

9. Warranty (Liability for Defects)<\/strong><\/h2>\n\n\n\n

(1) The statutory warranty period of 24 months applies.
(2) TameGuard products are sold in the 3D printing process<\/strong> manufactured. Minor visible layer lines, surface textures, minimal deviations or slight dimensional tolerances are due to the manufacturing process and represent no shortage<\/strong> provided that function and safety are not impaired.
(3) In the event of material defects, breakage, manufacturing defects or missing components, the customer shall receive a free replacement or a refund.
(4) The warranty excludes damage caused by:
\u2013 improper or unintended use,
\u2013 wrong size choice,
\u2013 excessive mechanical stress,
\u2013 independent modifications,
\u2013 Use contrary to the product instructions,

10. Liability<\/strong><\/h2>\n\n\n\n

(1) The seller shall be liable without limitation for claims by the customer for damages.
\u2013 in the event of damage resulting from injury to life, body or health,
\u2013 in cases of intentional or grossly negligent conduct.<\/p>\n\n\n\n

(2) In cases of slight negligence, the seller shall only be liable for breaches of essential contractual obligations (cardinal obligations). In this case, liability shall be limited to foreseeable damages typical for this type of contract.<\/p>\n\n\n\n

(3) TameGuard accepts no liability for damages resulting from improper, negligent, risky, or unintended use of its products. This includes, in particular:
\u2013 Use of ring sizes that are too tight or unsuitable,
\u2013 excessively long or uninterrupted wearing times,
\u2013 improper fastening of the components,
\u2013 Overstretching, tension or excessive pressure,
\u2013 Use during physically demanding or risky activities,
\u2013 Modification or manipulation of the products.<\/p>\n\n\n\n

(4) The seller accepts no liability for skin reactions such as redness, irritation, pressure sores, or individual intolerance reactions to PETG or TPU. Such reactions are usage-related and person-specific and do not constitute a defect.<\/p>\n\n\n\n

(5) The customer is responsible for checking for possible allergies or intolerances to the materials used.<\/p>\n\n\n\n

11. Retention of title<\/strong><\/h2>\n\n\n\n

The goods remain the property of the seller until full payment has been received.<\/p>\n\n\n\n

12. Data protection<\/strong><\/h2>\n\n\n\n

The terms and conditions that can be viewed in the online shop apply. Privacy Policy<\/a>.<\/p>\n\n\n\n

13. Choice of law and jurisdiction<\/strong><\/h2>\n\n\n\n

(1) German law shall apply, excluding the UN Convention on Contracts for the International Sale of Goods.
(2) In relation to consumers outside Germany, this choice of law shall only apply to the extent that it does not deprive them of the protection afforded by mandatory legal provisions of their country of residence.
